Apply In Person:

  1. To File Notice of Ceasing to Hold office as an Insolvency Practitioner in person, the applicant should contact the Corporate and business registration department in Mauritius. Contact link

  3. The application form should be fully completed and signed by the insolvency practitioner before submission.
  4. Applicants must ensure that they attach all the necessary documents such as a copy of the practitioner's registration certificate, the appointment letter from the court, the statement of assets and liabilities, and the statement of affairs of the insolvent company and they can be found under the “Required Document” section of this page.
  5. Applicants should Submit the completed application form to the Corporate and Business Registration Department in Mauritius, along with the required documents, to be considered for the desired opportunity.
  6. The Applicant may be required to appear before the Authorities to provide further information and/or answer queries related to the application to ensure that all necessary paperwork is completed accurately and that all relevant regulations have been adhered to.
  7. Upon submission of the application form, the applicant should also pay the required fee for the registration to receive a confirmation letter from the Corporate and Business Registration Department, as per the authority’s request.
  8. Once the fee has been paid, the Corporate and Business Registration Department will review the application and decide as to whether to File Notice of Ceasing to Hold Office as an Insolvency Practitioner.
  9. Once the Corporate and Business Registration Department has approved the Notice of Ceasing to Hold Office as an Insolvency Practitioner, they will issue a confirmation letter and the Notice will be officially filed.
  10. The applicant should also submit a copy of the notice to the court to officially inform them of the practitioner's resignation, thus closing the case and allowing the proceedings to move forward.

EligibilityEdit

The eligibility requirements for filing a notice of ceasing to hold office as an insolvency practitioner in Mauritius are:

  • The insolvency practitioner must be registered with the Insolvency Practitioners Association of Mauritius;
  • The insolvency practitioner must have given written notice of his intention to cease holding office as an insolvency practitioner to the Association;
  • The insolvency practitioner must have given written notice of his intention to cease holding office as an insolvency practitioner to all creditors, debtors and other persons known to have an interest in the insolvency proceedings;
  • The insolvency practitioner must have given written notice of his intention to cease holding office as an insolvency practitioner to any other regulatory authorities, including the Financial Services Commission, as may be necessary;
  • The insolvency practitioner must have submitted all relevant documentation to the Insolvency Practitioners Association of Mauritius and/or the Financial Services Commission as may be required;
  • The insolvency practitioner must have taken all reasonable steps to inform any creditors, debtors and other persons known to have an interest in the insolvency proceedings of the ceasing of his office as an insolvency practitioner;
  • The insolvency practitioner must have obtained the necessary consents and approvals from all relevant authorities, including the Insolvency Practitioners Association of Mauritius and/or the Financial Services Commission, as may be necessary.
