Kenya - Suspend or Renewal of Registration with National Construction Authority
ProcedureEdit
Based on sufficient reason, a registered construction firm shall be renewed annually every beginning of the year.
An application for renewal of a registered construction firm with NCA should be submitted at least a month before the end of one year for which the permit remains valid. The construction firm is also required to submit a bi-annual progress report to the Authority.
- In Person
- i)Complete a the renewal Application form.
- ii)Attach all the relevant documents.
- iii)Attach the expired previous certificate if any.
- iv)Submit to customer service center at National Construction Authority head office.
- Note
A contractor shall submit proof indicating construction works contracts completed by the applicant prior to an application for renewal.
The Board may make a decision regarding the category in which a construction firm may be registered, other than the one applied for by the firm on on renewal.
The Authority shall notify the contractor in writing of such decision within 60 days after receiving the renewal application Form.
- On suspension
If a person/firm/contractor or applicant who is aggrieved by the decision of the Board as in sub-regulation 6(3) in relation to the category the Authority has recommended, such person may submit in writing a petition indicating the reasons of such grievance, sufficient to justify review of the assessment by Authority.

- The required documents are as follows-
- i)a certificate of incorporation from the Registrar of companies either as a limited liability company, partnership or sole proprietorship;
- ii)in case of a limited liability company, the Memorandum and Articles of Association is certified by the Registrar of companies,
- iii)a resolution from the technical director who shall be authorized by the Board through Board resolution to take responsibility on all technical matters.
- iv)the curriculum vitae for each Director / Partner.
- v)Provides the Authority with the PIN, VAT and Tax compliance.
- vi)Provide evidence of existence of a bank account in the name of the construction company.

All Companies must register with National Construction Authority, and be familiar with the rules relating to the Authority.
Required InformationEdit
- i)a copy of its Articles of Association
- ii)a copy of the Regulation for investment Authority.
- iii)a copy of its memorandum of association and Articles of Association;
- iv)a copy of the power of attorney;
- v)a copy of the identity card
- vi)a copy of the certificate evidencing the domestic investor status and his recent two passport size photographs;
- vii)a photocopies of the memorandum of association and Articles of Association; .

Need for the DocumentEdit
National construction Authority is responsible for renewal approval, monitoring and control of construction industry in Kenya.
When some construction companies are rouge in nature and do not follow the Authority regulations during their operation,the NCA take action of suspending their registration permit, The action also includes denial of renewing their registration certificate.
The National construction Authority can suspend any contractor on the following ground:
- a)if the Authority is convinced the construction firm is convicted of an offence under the Act;
- b)If the firm is found guilty of any act or omission amounting to improper,disgraceful conduct or gross professional misconduct, after due inquiry held by the Authority.
- c) has breached the regulations or by-laws of the Authority.
The National Construction Authority has powers to censure or suspend a registered construction company for such a period as it may specify. or it can take legal action against any registered construction company.
