Kenya - Obtain License to Discharge Treated Waste Water into the Environment

Apply In Person

  1. The application for discharge of effluent into the environment should be made to the National Environment Management Authority (NEMA). Please view the National Environment Management Authority contact details through this NEMA Contact Details.
  2. First, the applicant should collect water effluent sample/s and submit the sample/s to the NEMA-approved laboratory for adequate testing and obtain the test results. Note: the sample/s should be delivered to the laboratory within 24-48 hours to obtain accurate results. Please view NEMA Designate Laboratories.
  3. After obtaining the water effluent test results, the applicant should obtain the application form for effluent discharge into the aquatic environment from the NAME office or download the form through this Application form for effluent discharge into environment (FORM 1).
  4. Then the applicant should complete the application form correctly as instructed in this guideline Guidelines to Filling-In Application Form for Effluent Discharge Licence.
  5. Upon filing the application form, the applicant should attach the laboratory analysis results to the complete form and visit the National Environment Management Authority to apply.
  6. The applicant should pay the application fee of Ksh. 5000 at the cash desk and obtain the payment receipt.
  7. Then the applicant should submit the license application to the officer at the licensing desk.
  8. The National Environment Management Authority officer will receive the application and verify of all the components of the application are completed correctly and issue the applicant with an acknowledgment receipt.
  9. Then the National Environment Management Authority through the director general’s office will evaluate the application and if the application meets the required condition, the application will be approved.
  10. Once the application is approved, the National Environment Management Authority will issue the Effluent Discharge License (EDL) to the applicant within 21 days of applying. Note: If the application is not approved, the Authority will inform the applicant in writing of further actions to undertake to satisfy the application requirements.

EligibilityEdit

  • Every local authority or person operating a sewage system or owner or operator of any trade or industry discharging wastewater into the environment is eligible to apply.



FeesEdit

Application for discharge of effluent into the environment for all facilities is Ksh. 5000.00
Annual license fees for discharge of effluent into the environment: -

  • Sewerage service providers - Kshs.500, 000.00.
  • Institutions Ksh. 20,000.00.
  • Others Ksh.10,000.00.
  • Inspection of records/effluent register - Kshs.200.00.
  • Variation of effluent discharge license - 10% of the annual license fee.
