Kenya - Apply for Project Registration with the National Construction Authority (NCA)

Apply Online

  1. To apply for project registration with the National Construction Authority (NCA), applicants are required to visit the NCA online portal
  2. Once on the portal, the applicant should hover the mouse cursor over the “Project Registration” hyperlink on the top menu bar and click on it.
  3. This will redirect the applicant to the Project Registration Online Portal page, click on the “Log in” tab.
  4. Applicants who are already registered as a user should log in to the portal using their credentials and proceed with the application process.
  5. Applicants that do not have an account with the NCA portal, will be required to register by, hovering the mouse cursor over the “REGISTER” tab and clicking on it to proceed with the registration process.
  6. Once registered applicants should log into their account with the email address and password used during the registration process.
  7. Click on the “ New Application” tab, then select “ Register Construction Project” on the extended menu.
  8. This is followed by the application form being displayed, fill out all the mandatory fields accurately, before clicking on the “ Save & Exit” tab to proceed to the next of the application.
  9. Upload all the supporting documentation as requested on the site, before submitting the application for processing by the Authority.
  10. Once the application is received, the developer should ensure that all appointed consultants confirm their engagement via email and that all documents are uploaded before verification.
  11. A verification email requesting them to await a due diligence site inspection will then be sent.
  12. After on-site due diligence is conducted, the application will either be approved or returned with comments.
  13. Depending on whether the project is a low, medium, or high risk, the certificates will be sent to the developer’s email within 7 days with a unique Project ID.

In case of a Local developer/owner registering a project

  • The contractor and sub-contractor must be registered by NCA and must have a valid practicing license for the current financial year.
  • The project consultants (for example the engineer (s), architect, and quantity surveyor) must be duly registered with their respective professional regulatory bodies, such as the Engineers Board of Kenya (EBK) and the Board of Registration of Architects and Quantity Surveyors (BORAQS).
    • They must have valid practicing licenses
  • Approved architectural and structural drawings.
  • Physical planning forms (county approval permits/ letters/PPA2)
  • Other statutory and regulatory approvals such as NEMA, EPRA, WRA, and KCAA licenses where applicable.
  • Bill of quantities summary page duly signed and stamped by the quantity surveyor.
  • Copy of developer’s Kenya Revenue Authority (KRA) PIN.
  • Signed contract/tender form or signed agreement by developer with the contractor.
  • Supervision Commitment Letters by consultants and/or agreements/contracts by developers with consultants.


In case of a Foreign developer/owner registering a project

  • Copy of company compliance certificate (attach copies of passport(s) and work permit(s) for the director(s) or certificate of incorporation and CR12.
  • Academic certificates and testimonials for the technically qualified directors.
  • Academic certificates and testimonials for the technically qualified staff.
  • Work permit(s) for the technically qualified staff.
  • Certified copies proving ownership of assets
  • A valid KRA tax compliance certificate.
  • A certified copy of the current business license.
  • If applying for electrical engineering works, attach a license from the Energy and Petroleum Regulatory Authority (EPRA)
  • If applying for communications engineering works, attach a license from the Communications Authority of Kenya (CAK).
  • Three years ‘audited accounts, certified by a person registered with the Institute of Certified Public Accountants (ICPAK) and other relevant financial information.
  • Proof of firm’s past experience locally/other jurisdictions and ongoing project(s) if any.
  • Proof of plant, equipment, and machine holdings;
  • Certified copies of documentation proving ownership of assets
  • Sworn affidavit (see sample on NCA website)
  • An undertaking, in writing, stating that the foreign firm shall:
    • Subcontract or enter into a joint venture with a local contractor for not less than 30% of the value of contract work for which temporary registration is sought
    • Transfer technical skills not available locally to a local firm or person in a manner that the Authority may determine from time to time.

EligibilityEdit

  • It is the responsibility of the developer and not the contractor to register his/her project be it commercial or private without exceptions.

  • Project registration is currently free of charge.



ValidityEdit

  • The project registration certificate shall mention the period on which the project is supposed the run, where the project is not completed within the stipulated period, the developer can request for the period to be extended via the NCA portal.
