Ghana - Obtain Permit to Construct Petroleum Refinery or Petrochemical Plant

Apply In-Person:

  1. To apply for Permit to Construct Petroleum Refinery/Petrochemical Plant, the applicant has to approach the National Petroleum Authority (NPA) office in Ghana Contact link
  2. Applicant must obtain the application form from NPA department.

  5. A permit shall be granted in the following sequential stages culminating in the grant of a license to operate the plant.
    • License to establish a Refinery
    • Permit to construct a Refinery, and
    • License to operate a Refinery.
  6. The application for a license to establish a Refinery shall be accompanied by a non refundable administrative fee of GHS $20,000.00 as well as the following documents or information and that can be found under the "Fees" section of this page.
  7. The applicant shall submit the required documents for review to ensure statutory compliance.
  8. After satisfying the statutory requirements the applicant shall submit the detailed engineering of the Refinery to the Authority as specified in the following guidelines.
  9. Applicants approach the NPA office and the applicants can get their application form for Permit to Construct Petroleum Refinery/Petrochemical Plant.
  10. Applicant has to enter all the information in the application form.
  11. Applicant must make sure to carry all the necessary documents that are mentioned under “Required Documents” section of this page. (Both photocopies and originals)
  12. The company shall pay an annual fee comprising a fixed fee and a capacity charge based on the production capacity of the Refinery as detailed in the “fees” section of this page.
  13. If all the above mentioned procedures were followed properly by the applicant, the application form will be viewed by the concerned authorities and the applicant will be notified regarding their license/Permit.
  14. Following the completion of mechanical erection, the Authority’s Engineers will carry out on-the-spot physical inspection of the plant to ascertain conformity with the approved design. Upon the receipt of a satisfactory report, the Authority will grant approval for commissioning of the plant and subsequently issue a license to operate the Refinery.
  15. The Certificate of permit will be issued within 30days.

LICENCE TO ESTABLISH A REFINERY

  • Certificate of Incorporation,
  • Certificate to Commence Business,
  • Regulations 8 to 82; Second Schedule to the Companies Code, 1963 (Act 179)
  • Proof of Title to the land,
  • Feasibility studies of the Refinery project.


PERMIT TO CONSTRUCT A PETROLEUM REFINERY

  • A Development and Building Permit from the Area\Town Planning Authority approving the construction of the Refinery, a petroleum storage depot, bulk sale and distribution on the proposed site.
  • A fire report signed by the Chief Fire Officer or a Regional Fire Officer evidencing that arrangements proposed for the prevention and fighting of fire coupled with good housekeeping at the site are satisfactory,
  • A Geo-technical Report indicating the general geology of the project area, seismicity of the area, soil profile, groundwater condition, etc.
  • Environmental Impact Assessment culminating in the grant and issue of an Environmental Permit from the Environmental Protection Agency.


The following documents shall be submitted to the Authority to ensure compliance:

  • Process Flow Diagram, Detailed Piping and Instrumentation Diagram (P&ID) of
  • The process units, utilities and off sites,
  • Final process technology selection and licensors,
  • Detailed Material balances,
  • List of equipment,
  • Equipment test procedures,
  • Approved building plans,
  • Quality control program of the designers,
  • Final Project implementation schedule,
  • Detailed Post Construction Environmental Impact Assessment,
  • Detailed crude oil (feedstock) supply and product meter proving procedure and
  • Evacuation schemes and
  • Electrical single line diagrams.

  • A body corporate registered under the Companies Code, 1963 (Act 179) or
  • A partnership registered under the Incorporated Private Partnerships Act, 1962 (Act 152) or
  • A foreign individual or foreign company in a registered joint venture relationship with a citizen of Ghana or a Ghanaian company.

CONSTRUCTION PERMIT FEE FOR REFINERY

  • Production capacity fees(USD) less than 1000 MT/day is 30,000,00
  • Production capacity fees(USD) 1000 to 5,000 MT/day is 75,000
  • Production capacity fees(USD) more than 5,000 MT/day is 100,00.00


The company shall pay an annual fee comprising a fixed fee and a capacity charge based on the production capacity of the Refinery as detailed given below:

  • Production capacity fees (USD) less than 1000 MT/day is 50,000/year + capacity charge of (500/1,000bpsd)/year
  • Production capacity fees(USD) 1000 to 5,000 MT/day is 150,000/year + capacity charge of (500/1,000bpsd)/year
  • Production capacity fees(USD) more than 5,000 MT/day is 300,000/year + capacity charge of (500/1,000bpsd)/year

  • License validity is for 1 year and this license is renewable annually.

As a Regulator, the Authority ensures that the industry remains efficient, profitable, fair, and at the same time, ensuring that consumers receive value for money.

BASIC DESIGN AND CONCEPT ENGINEERING

  • Preliminary Marketing Plan, indicating whether domestic, export, or if both markets are being targeted.
  • Preliminary product slate, indicating volumes or tonnage and product specifications. The specifications must conform to local specifications if the product is to be sold on the domestic market.
  • Preliminary crude oil or feed stock slate and assays of the proposed crude and/or feed stock.
  • Proposed site.
  • Block flow scheme showing process configurations and capacities including utilities, offsite and wastewater treatment facilities.
  • List of proposed process technologies, and relevant licensors.
  • Proposed crude oil or feed stock supply and product evacuation scheme.
  • Proposed safety provisions and preliminary environmental impact statements.
  • Infrastructural support strategy (community support plan/ programme).

Need for the DocumentEdit

  • A provisional licence will initially be granted and issued to all applicant companies requiring Petroleum Product bulk consumer Licences.  Under this licence, applicant companies cannot lift products directly from the Tema Oil Refinery, the depots or any other refinery except through the sponsoring Oil Marketing Company/LPG Marketing Company.
