Procedure

Apply In-Person:

1. To Get General Power of Attorney in Marital Matters, the applicant must approach the Ministry of Justice Contact link
2. Obtain a Power of Attorney registered in the office of the Sub-Registrar having jurisdiction over the principal's area of ​​residence.
3. Kindly approach the Sub-Registrar office and confirm the date of registration.
4. The applicant should purchase the stamp papers for Get General Power of Attorney as per arrived/notified value.
5. On the scheduled date the principal, the agent (power of attorney) and the witnesses should go to the Registrar's office and both parties wait for their turn.
6. The Applicant Kindly follow the instructions of the processing authority in their scheduled slot.
7. The applicant should have the documents mentioned in the "Required Documents" section of this page.
8. Pay the registration fees as mentioned in "Fees" section given in the page.
9. The applicant original ID is required on the date of registration for verification of authenticity and will be returned on the same day.
10. After verifying the details in the applicant, the Registrar will sign the respective order.
11. The principal, agent (power of attorney) and witnesses must sign the register, as well as complete the register in the prescribed places of the document.
12. This process at Registrar's office is completed on the same day (in case of any unavoidable circumstances it may happen on the next working day).

Eligibility

• Agent must be of legal age and mentally competent to execute such a document.

Fees

• The fees for this procedure are 20 pounds + a relative fee based on the value and duration of half a percent, up to 10 pounds.

Validity

• A POA always become null and void upon death of principal or on the expiration date specified in the document.
• Till the purpose for which the power of attorney is granted, is accomplished.
• Till the power of attorney is revoked / cancelled by means of a registered cancellation deed (as the power of attorney relating to the property is registered).

• In case of Marital Matters, when a party resides outside the country and cannot be present for the execution of the divorce, he/she can authorize a person by way of a notarized Power of Attorney to represent him/her after submitting an application to the Family Court under the act.
• In any case, if there is a deficit in the stamp duty, the sub-registrar has all the rights to reject the applicants registration procedure.
