Apply In-Person
- To obtain an Air Pollution Registration Certificate, the applicant should visit the Department of Waste Management & Pollution Control head Offices or regional office to apply. (Contact details are listed under the “Office Locations & Contacts” section of this page).
- Express your interest to the receptionist/ secretariat at the front desk at the nearest Department offices and collect all necessary forms for the application of an Air Pollution Registration Certificate. Forms are available at the Enquiries Desk at any of the Department offices.
- The Air Pollution Control Officers are always available to guide every applicant on how to fill the form correctly.
- Attach all the required documents (see required document below) to the completed form and submit the documents to the Air Pollution Control unit.
- The Air Pollution Control unit receiving Officer will then verify, if all the necessary information and documents have been provided and that the applications comply with the selection criteria, if everything is in order, pay the prescribed fees and obtain an acknowledgment slip; containing details of the application.
- The application is then assessed based on the information and documents that have been provided, the department will then contact the applicant and book for an inspection visit that will be conducted by the Air Pollution Control Officer.
- Note; the applicant or an authorized official is required to be present during the inspection visit.
- The Air Pollution Control Officer shall visit the facility to evaluate the environmental impact the facility will cause on the environment and the neighboring communities, by ensuring the industrial process has met the following requirements;
- The best practicable means have been installed and will be employed for preventing or reducing to a minimum the escape into the atmosphere of objectionable matter which is produced or is likely to be produced by any such industrial process.
- The facility is fully equipped and fit for the industrial process in question.
- The locality of the industrial process in question may reasonably be permitted to be carried on in the locality concerned, having regard to the nature of that process, the character of the locality in question, the purposes for which other premises in such locality are used, and any other considerations, and that the carrying on of that industrial process in or on the premises in question would not conflict with any town planning scheme in operation or course of preparation in respect of such locality.
- A copy of the report finding will be given to the applicant and if any modification or upgrading is required, Corrective Action and Preventive Action Report (CAPA) report will be issued and the applicant will be required to rectify the problem by taking the necessary steps within a period specified in the notice for preventing or reducing to a minimum the escape into the atmosphere of any such objectionable matter.
- Upon successful implementation of the CAPA, a follow-up inspection may be conducted by Air Pollution Control Officer to ascertain the effectiveness of the implementation (where applicable).
- If he is satisfied that all the conditions as required for the application are met, the Air pollution Registration Certificate will be drawn up, signed, and stamped by the Air Pollution Control Officer and made available for withdrawal by the applicant against his/her identity document and the acknowledgment letter at the department's Air Pollution Control Office, upon payment of the required fees.
- The pollution Registration Certificate will be subjected to specific conditions and regulations as the Air Pollution Control Officer may see fit. (please refer to the “instruction” section of this page for more information)
Appeals from decisions of Air Pollution Control Officer
- Any person who is aggrieved by a decision of the Air Pollution Control Officer refusing an application for a registration certificate or cancelling or suspending a registration certificate or imposing any requirement; may within one month appeal against such decision to the Atmospheric Pollution Appeals Board in written arguments or explanations of the grounds of his appeal and may further appear before the Board in person or through a representative (who shall be an advocate or an attorney) and cause any evidence to be tendered or any argument or explanation to be submitted to the Board in support of the written arguments or explanations of his grounds of appeal.

Conditions of registration certificates;
- A registration certificate shall specify-
- The situation and extent of the building or plant, or proposed building or plant, to which it relates;
- The nature of the industrial process intended to be carried on
- The raw materials intended to be used, the nature of the operations to be carried on, and the products to be produced;
- The appliances to be installed and any other measures intended to be taken to prevent or reduce to a minimum the escape into the atmosphere of any objectionable matter; and
- The proposed measures for the disposal of the effluents discharged from appliances installed with the view referred to in paragraph (d).
- A registration certificate shall be subject to the condition that all plant and apparatus used to carry on the industrial process in question and all appliances for preventing or reducing the escape into the atmosphere of the objectionable matter shall at all times be properly maintained and operated and that the holder of the certificate shall ensure that all other necessary measures are taken to prevent the escape into the atmosphere of objectionable matter.
- The Air Pollution Control Officer may at any time by notice in writing require the holder of any such certificate to take steps to ensure the more effective operation of the appliances provided for in such certificate for the prevention of the escape into the atmosphere of objectionable matter produced by the industrial process to which the certificate relates.
- The Air Pollution Control Officer may at any time by notice in writing require the holder of any such certificate to take such steps as may be reasonable, having regard to the cost involved, to ensure the more effective prevention of the escape into the atmosphere of objectionable matter produced by the industrial process to which the certificate relates through some other or improved process or equipment specified in such notice.
- Any such holder shall be allowed a reasonable period to be specified in the relevant notice within which to take any steps specified therein.
- If the holder of a registration certificate fails to comply with the conditions referred to in subsection (2) or any requirement under subsection (3) or (4), the Air Pollution Control Officer may by notice in writing call upon such holder to comply with such conditions or requirement within a reasonable period specified in the notice, and in the event of his failure to comply with the said conditions or requirement within the period so specified the holder shall be guilty of an offense.
- If the holder of a registration certificate is convicted of an offense under subsection (6) and notice of appeal against such conviction has not been lodged timeously or such appeal has failed or been abandoned or withdrawn, the Air Pollution Control Officer may cancel the registration certificate or suspend the operation thereof for such period as he may deem fit.
- To ensure that any conditions or requirements imposed by or under the provisions of this section are complied with or carried out the Air Pollution Control Officer may inspect, or order an inspector to inspect, any building or plant to which a registration certificate relates.
