Botswana - Obtain Special Flight Permit

- The application to obtain Special Flight Permit shall be made to the Civil Aviation Authority of Botswana (CAAB) office.CAAB Contact Details
- The application shall be made in writing in the form of a letter for a Special Flight Permit should be submitted to the CAAB at least ten (10) working days before the date of the intended flight.
- The application letter should be submitted to the CAAB head office, Flight Safety unit. Any omission of the required information or documents will render the application process incomplete.
- Upon receipt of the application, the Flight Safety officers will check for discrepancies or ineligibility in the application documents. If a discrepancy that cannot be immediately corrected exists in any of the documents, the application and all the submitted documents will be returned to the applicant and should not be re-submitted until the discrepancy has been rectified/ corrected.
- If the Flight Safety officer is satisfied that all the requirements have been met for the application for the license, then the application is registered for processing and consideration.
- Applicants will be required to pay the prescribed fees as mentioned on the CAAB fee schedule, refer to the “Fees” section of this page, which is payable either in cash at the CAAB cashier counter/accounts office or by cheque in favour of the CAAB.
- The applicant is issued with a payment slip and an acknowledgment slip as a proof of submission of the application and for inquiry referencing if the need arises.
- Since a Special Flight Permit is issued to cover the operation of an aircraft that may not meet airworthiness standards, the CAAB will require the applicant to make appropriate inspections or tests, for the purpose of determining and prescribing appropriate operating limitations.
- Upon being satisfied, the application meets the requirements and that the aircraft is appropriately equipped and safe to fly, the CAAB will issue a Special Flight Permit specifying operating limitations and validity period.
- Notice of the decision (Approval, Deferral, or Rejection) for the application will be communicated to the client in writing or by phone.
- While collecting the permit, applicants will be required to procedure their identification document, acknowledgment slip/approval letter, proof of payment of the permit fee to be validated by the CAAB Flight Safety office.
- The applicant will be made to sign on the signature pad/book and will be issued with the printed special Flight Permit at the CAAB Flight Safety Office.

- Make, model, serial number, and registration marks of the aircraft.
- Purpose of the flight.
- Proposed itinerary.
- Crew required to operate the aircraft (Note: Provide full names of all crew members, and include copies of their licenses (where applicable)
- Details of non-compliance with applicable airworthiness requirements.
- Any restriction, the applicant considers necessary for the safe operation of the aircraft.
- Any other information considered necessary by the CAAB for the purpose of prescribing operating limitations.
- Full names of other persons other than the crew, and their role in the aircraft, where possible;
- Names and address of the registered owner.
- A properly executed maintenance endorsement in the aircraft permanent record by a person or organization authorized in accordance with the Civil Aviation (Airworthiness) Regulations, stating that the subject aircraft has been inspected and found to be safe for the intended flight.
- Payment receipt of the prescribed fees.
- Any other additional documents requested for by the CAAB.
- Note: All copies of attached documents should be certified by an advocate/commissioner for oaths.

EligibilityEdit
The Authority may issue a special flight permit for an aircraft that is capable of safe flight but unable to meet applicable airworthiness requirements for the purpose of:
- Flying to a base where weighing, painting, repairs, modifications, maintenance, or inspections are to be performed or to a point of storage.
- Flying for the purpose of experimenting with or testing the aircraft including its engines and equipment.
- Flying for the purpose of qualifying for the issue, renewal or validation of certificate of airworthiness or restricted certificate of airworthiness and the approval of a modification of the aircraft.
- Delivering or exporting the aircraft.
- Evacuating aircraft from areas of impending danger and
- Operating at mass in excess of the aircraft's maximum certified takeoff mass for flight beyond normal range over water or land areas where adequate landing facilities or appropriate fuel are unavailable with the excess mass limited to additional fuel, fuel-carrying facilities, and navigation equipment necessary for the flight.

- A Special Flight Permit shall be valid for fourteen (14) days unless a shorter period is specified by the CAAB.
- For ferry flights (i.e. flights for the purpose of delivering the aircraft, or relocating it to a point of maintenance or storage), the permit will be valid for one (1) flight only, expiring immediately upon arrival at the destination.
- A Special Flight Permit is not renewable. When it expires, a new application should be submitted for another permit to be issued.

Important Notes
- For an aircraft that would otherwise qualify for a Certificate of Airworthiness (C of A) but is unable to meet the applicable airworthiness requirements (i.e. C of A is not in force), a Special Flight Permit may be issued by the Civil Aviation Authority Botswana in accordance with the Civil Aviation (Airworthiness) Regulations. Such a Permit will have a limited validity period depending on the circumstances under which it is issued.
- An application in the form of a letter for a Special Flight Permit should be submitted to the Authority at least ten (10) working days before the date of the intended flight.
- An applicant for a special flight permit should show that the aircraft is properly registered and marked and has identification plates affixed to the aircraft.
- The operator shall inform the state of the conditions of the aircraft and intended flight and the operator must obtain their consent.
- The Authority shall require a properly executed maintenance endorsement statement in the aircraft's permanent record by an authorized person stating that the subject aircraft has been inspected and found to be safe for the intended flight.

A special flight permit is a document issued to the operator of an aircraft, whose certificate of airworthiness is not in force, or to the owner of an aircraft that does not qualify for the issue of a certificate of airworthiness.

The Authority may issue a special flight Permit for a foreign aircraft if
- The State of Registry has issued a Permit for the aircraft and has listed applicable limitations:
- The aircraft logbook contains a statement that the aircraft has been inspected and is in a safe condition for the intended flight.
- The person intending to operate the flight acknowledges and adheres to all listed limitations.
- A Permit to fly may be issued for a foreign registered aircraft that does not meet applicable airworthiness certification specifications (i.e. aircraft without Type Certificate) but is capable of safe flight. The application should be submitted in accordance with the procedure outlined above.
- The CAAB may issue a Special Flight Permit validation for a foreign registered aircraft that may not meet applicable airworthiness requirements but is capable of safe flight to allow the aircraft to cross Botswana airspace. The application for validation must be made in writing and attaching a copy of the Special Flight Permit issued by the State of Registry.
- A Permit issued to a foreign aircraft is not renewable. When it expires, a new application should be submitted for another permit to be issued.

Operating Limitations
When issuing a Special Flight Permit, appropriate limitations should be prescribed to minimize hazards to persons or property. The following limitations are considered to be essential in all Special Flight Permits:
- The Special Flight Permit (or certified copy thereof) should be on board the aircraft at all times when operating under the terms of the Special Flight Permit.
- The registration marks assigned to the aircraft by the State of Registry should be displayed on the aircraft in conformity with the requirements of that State.
- Persons or property should not be carried for commercial purposes in the aircraft.
- A person should not be carried in the aircraft unless that person is essential for the purpose of the flight and has been advised of the terms of the Special Flight Permit and the airworthiness status of the aircraft.
- The aircraft should be operated by the crew who are aware of the purpose of the flight and any limitations imposed and who hold appropriate certificates or licenses issued or validated by the CAAB.
- All flights in that aircraft should be conducted so as to avoid areas of heavy traffic or any other areas where flights where flight might create hazardous exposure to persons to persons or property.
- All flights should be conducted within the performance operating limitations prescribed in the aircraft flight manual and any other additional limitations as may be specified by the CAAB.
- The flight shall be conducted during DAY VMC and within the parameters, as dictated by the Configuration Deviation List (CDL) / Minimum Equipment List (MEL).
- The operator must satisfy itself that the aircraft is fit for the intended flight and all maintenance and operational requirements have been met, and
- The Special Flight Permit is not valid for use in foreign airspace unless validated by foreign civil aviation authorities whose airspace will be overflown.
