Botswana - Obtain Registration Certificate for Facilities using Nuclear Technology

The application for a Registration Certificate for Facilities using Nuclear Technology shall be made to the Radiation Protection Inspectorate (RPI) department, which is under the Ministry of Tertiary Education, Research Science and Technology. Ministry Contact Details
Applicants are required to collect and complete the following forms, ionizing safety user registration form (Form 01) and application for license/permit to import/export/transport/possess and use of radioactive sources/ generators/equipment (form 02). Applicants are required to submit the supporting documents as mentioned under the” Required Documents” section of this page, in addition to the two duly completed application forms in all respect to the office of the Radiation Protection Inspectorate located at, Unit B, Plot 132, Gaborone International Finance Park. Any omission of these documents will render the application process incomplete.
Applicants will be required to pay the application fee as mentioned under the “Fees” section of this page and obtain a payment receipt that will serve as proof of submission of the application.
Upon receipt of the application file, the Inspectorate staff will assess the file, if all the necessary information and documentation has been provided and that the applications comply with the selection criteria, and provide feedback to the applicant within ten (10) days.
Applications that have passed the assessment stage will be published in the Government Gazette to invite the general public to express their concerns and submitted for the next scheduled meeting of the Radiation Protection Board for final evaluation.
- Please note that applications must have passed the assessment stage at least three (3) weeks before the Board meeting date in order to be submitted for that meeting.
Upon receipt of the application file and the inspectorate assessment report the board will further assess the applicant if he is a proper person to be granted the registration certificate by making such inquiry and consult such persons or authorities as it may consider appropriate.
The Board will also consider any written notice of objection or other representations made by members of the public
Applicants will be informed of the decision of the board within three (3) days of the board meeting by the Radiation Protection Inspectorate office.
If approved the facility will be registered by the Radiation Protection Inspectorate registrar and the registration certificate will be drawn up as directed by the board and made available to be withdrawn by the applicant upon producing their identity document and the payment receipt.
The registration certificate shall be subject to such terms and conditions as the Radiation Protection Board may consider necessary, such conditions shall be endorsed in the certificate.

Appeal to the Minister

Any person who is aggrieved by a decision of the Board may appeal to the Minister by the lodging, with the Director, a written notice of appeal together with grounds of appeal, within 14 days of the date of the decision. The Minister may, on receipt of a notice, appoint an Appeal Committee to advise him or her on the subject matter of the appeal.

Required DocumentsEdit

A Radiation Safety and Protection program/plan; that addresses all relevant radiation safety issues including;
- for radioactive sources obtained regularly, the quantity in each shipment and the frequency of supply; radiation monitoring instruments available on the premises and their calibration; arrangements for personnel radiation monitoring; the proposed method for disposing of radioactive waste or of sealed sources which are no longer required; the security of sources; source storage conditions; the protective equipment that is required and handling techniques for the radioactive sources; the qualifications required of persons who use radiation sources; regular radiation safety training program for workers; where the sources are used for human diagnosis or therapy, the name and qualifications of the responsible medical practitioner, how patient exposures are justified and optimized and the dose guidelines adopted by the practice; details of emergency procedures, etc.
A Scale Plan of the premises must be provided with the application showing the location where the radioactive sources are normally used, manufactured, stored, or otherwise dealt with. The plan must show the purpose of all adjacent areas and the nature of the construction materials. For unsealed substances, additional information on waste lines, laboratory facilities, surface finishes, and ventilation is also required. A report from a Qualified Expert must also be provided certifying that the premises and facilities are so constructed, and work practices instituted, that compliance with the prescribed dose and discharge limits will be achieved.
Curriculum vitae and certified copies of academic certificates of the nominated radiation safety Officer and his/her Deputy.
Certificate of Incorporation (Form 4).
Practice authorizations from Botswana Health Profession Council for all operators (Medical practice only).
Any other additional supporting documentation as requested by the Radiation Protection Inspectorate.

EligibilityEdit

Any person or companies that engage in or intend to engage in any activities of the following activities that involve Nuclear Technology are eligible to apply;
- Acquire, own, possess, transfer, distribute, sell, use, manufacture, transport, import, or export any radioactive material, radioactive substance, or source.
- Administer any radioactive substance to any person for the purposes of diagnosis, treatment, or research.
- Add radioactive substances in the production and manufacture of foodstuffs, medicinal products, cosmetics, and products for household use.
- Physically or chemically alter or modify part or all of any radioactive material, substance or source; or
- Manage or dispose of any radioactive waste.

Note: License/authorization fees, payable in cash, cheque, or adjustment voucher vary according to the risk associated with the radiation sources and are reviewed annually.

ValidityEdit

The registration certificate is valid for one year unless revoked or suspended by the Radiation Protection Inspectorate department.

The time around for processing the application is between three weeks and three months after passing the initial assessment.

InstructionsEdit

Any person/company who applies for the registration certificate for facilities using nuclear technology shall;

prior to submitting the application, make an assessment of the likelihood, nature, and magnitude of the exposure attributed to the sources and all necessary steps to be taken for the protection and safety of radiation workers and the public.
Have a safety and environment assessment made and submitted to the Board as part of the application, where the potential for exposure is greater than any level specified by the Board.
Establish and submit to the Board an incident response plan.
Furnish any additional information that the Board may consider necessary.

Need for the DocumentEdit

A Registration Certificate is required for any facilities that wish to engage in any activities that involve nuclear technology.
This is to ensure safe use of atomic energy and nuclear technology, hence the operators/users, public, and the environment are protected from the adverse effects of ionizing radiation, in relation to the Radiation Protection Act, 2006 and Radiation Protection Regulation 2008.
