Botswana - Obtain License for Manufacturing Petroleum Products

Apply In-Person

  1. The application for Manufacturing Petroleum Products License shall be made to the Botswana Energy Regulatory Authority (BERA) office.BERA Contact details and Map Location
  2. Applicants are required to collect and complete the prescribed application form, obtainable at the BERA office. Copies of this form are not available online.
  3. Submit the completed form in all respect and the relevant should documents as mentioned under the “Required Documents” Section of this page, to the BERA office. Any omission of the supporting documents will render the application process incomplete.
  4. Upon receipt of the application file, the BERA receiving officer will verify if all the information and documentation are in order, before registering the application to be forwarded for assessment, processing, and consideration by the BERA Licensing Board.
  5. The Authority shall, within 14 days of the date of receipt of an application, acknowledge in writing, receipt of the application. The acknowledgment letter will serve as proof of submission of the application and for inquiry referencing if the need arises.
  6. During the assessment process the board shall be guided by the following principles:
    • Whether the issue of the license will bring any benefits to the national economy and to consumers in the energy sector.
    • Whether the applicant can provide the service in respect of which the license application is made, in a safe and sustainable manner.
  7. If, after receipt of the application, the Authority is of the opinion that it requires further information to assess the application, the Authority may, within 28 days from the date of receipt of the application and by written notice, request for further information from the applicant or third parties, as may be identified by the Authority, and the notice shall:
    • Specify the information required from the applicant.
    • Where applicable, notify third parties of the application and invite comments from them.
    • Specify the time within which the information or comments shall be submitted to the Authority.
    • Specify the date by which the Authority intends to make a final decision on the application.
  8. The Authority shall notify persons likely to be affected by the authorisation of the application, by publishing a notice in the Gazette and two newspapers in circulation, publish the license it proposes to issue and invite interested parties to comment on the license within the time specified in the notice and it shall consider any objections raised during consultation and comments received from affected persons.
  9. The Authority shall notify the applicant, in writing, of its decision within 14 days from the date the decision is made, and where the Authority decides not to issue the license, it shall state the reasons in such notice.
  10. If approved, the applicant should visit the BERA office, and produce the BERA approval letter, identity document to be validated by the BERA authorized official, pay the prescribed license fee and collect the Manufacturing Petroleum Products License.
  11. The license shall be subjected to terms and conditions as the Authority deem fit. The licensee shall also be subjected to supervision and monitoring by the Authority.


Please note: Any person who is aggrieved by a decision of the Authority not to issue the license, or the terms and condition subject to the license, May within 30 days from the date of the notification or communication of the decision to him or her, applies for review or appeal against that decision to the High Court.

  • Application letter for Generation and Co-Generation of Electricity and Heat License addressed to Botswana Energy Regulatory Authority (BERA) and should detail the following:
    • The name and address of the applicant.
    • A description of the regulated sector-specific activity that the applicant proposes to carry out.
    • The geographic area where the applicant proposes to carry out the activity and the details of all facilities where the activity is to be carried out.
  • Evidence that the applicant has the:
    • Financial capabilities (support letter from financiers or bank statements, projections, etc.)
    • Requisite ownership or usage rights over the principal facilities to be used to perform the activity. (Title deeds, lease agreements, etc.)
    • Technical capabilities and the necessary experience to carry out the activity for which a license is sought. (Competence or skills, compliance to standards, engineering drawings, etc.)
  • valid Identity card or Passport for non-citizens(in case of an individual)
  • Valid Certificate of incorporation (in case of a company/business)
  • Any other supporting documentation as requested by the Botswana Energy Regulatory Authority (BERA).

  • Individuals (citizen or non-citizens) and registered businesses/companies, which wish to be involved in the following activities:
    • Undertakes commercial activities relating to the petroleum and gas sector.
    • Has a storage facility for regulated products exceeding 30,000L (including for own use).
    • Constructs petroleum and gas infrastructure.

ValidityEdit

  • The license validity is mentioned on the license. The license will remain valid for the duration stipulated, unless revoked, suspended, or cancelled by the Authority.
  • Upon expiring, the license is subjected to renewal.

A license granted shall be subject to such conditions and restrictions as the Authority considers necessary, including:

  • The duration of the license.
  • The activities which the licensee is authorized to carry out.
  • The scope of activities for which the license is issued
  • Where a licensee is licensed for more than one activity, a segregation of the regulated activities from other activities of the licensee for accounting and regulatory purposes.
  • Compliance by the licensee with the applicable laws, codes, standards, and decisions of the Authority.
  • Submission, by licensee and persons connected to the licensee's network, of technical codes for approval to the Authority.
  • The terms and conditions on which the Authority may amend, suspend or revoke a license.
  • The payment of license fees, by a licensee, to the Authority.
