Changing name can be done at the district administrative authority of residence or of habitual residence, or the last place of residence or habitual residence in Austria:
- The district administration
- In Statutarstdten: Municipal
- In Vienna: Municipal Department 26 (also for those who never had a resident or ordinarily resident in Austria)
For foreign nationals, the change of name governed by the law of their home state. In Austria, the name changes can only be performed if the foreign national is stateless, the nationality is unknown, and the people have to habitual residence in Austria or refugees under the Convention relating to the Status of Refugees and the Protocol Relating to the Status of Refugees resident or ordinarily resident in Austria.

If you are using, or wish to use, a name other than your registered name, there is no legal requirement that you formally change your name. It is, however, recommended that you change your name officially, both for identification and as evidence of your name change.
Name change generally refers to the legal act by a person of adopting a name different from their name at birth, marriage or adoption. The procedures and ease of a name change vary between jurisdictions.

Legal reasons for a change of the first name
For the change of the first name of one of the enumerated here statutory reasons must be:
- The former first name seems ridiculous or offensive
- The former first name is hard to pronounce or hard to write
- The applicant / the applicant is of foreign origin and want a first name, the / facilitates the classification of their domestic him
- This request for the name change must be lodged within two years after the acquisition of Austrian citizenship
- The applicant / applicant plans a first name, she / he has not resulted in good faith, being entitled to do

Reasons for the rejection of the name change request
A name change will not be granted if
- the change of surname would allow circumvention of the laws,
- the name or family name requested is not in use ridiculous, offensive or identifying persons in Germany,
- the family name is applied lawfully operated by another person, which plays a legitimate interest in excluding the applicant / the applicant of the leadership of the same family name (with exceptions provided by law),
- the family requested is composed of several names (with exceptions provided by law),
- would lead the requested amendment of the first or family name to avoid any confusion ability with another person enters,
- the proposed amendment of the first or family name to the welfare of a subject are not intrinsically beneficial owner thereof is detrimental,
- the first name requested is not in use or first name of the sex of the applicant / the applicant does not comply,
