Nigeria - Register a Trademark

Procedure[edit]

1.Start by identifying and instructing a local trademark attorney or agent in Nigeria, who will help you file and process applications for trademark registration at the Nigerian Registry of Trade Marks, Patents, Designs and Copyright. In this case if the attorney / agent is identified, you shall be required to issue him / her / it a Power of Attorney /Authorization on the prescribed form to enable him / her / it act on your behalf;

2.The authorized trademark attorney / agent on your behalf fills an application by submitting all the official documents and forms to the trademark office;

3.When documents are submitted, the trademark registrar issues a formal acknowledgement of receipt with official number and filing date of the application;

4.Thereafter an introductory search is conducted to find out if the trademark submitted is not similar to any existing and pending registrations trademark;

5.If found unique, the Registrar goes ahead and examines the application to assess its eligibility for registration. In the due course of examining, the registrar takes into consideration likely controversies with already registered or pending registration trademarks and the intrinsic registrability of the mark.

6.If the Registrar verifies and finds him / herself satisfied that the trademark is eligible for registration, he / she issues a letter/notice of acceptance to the applicant;

7.A trademark is then published in the Nigerian Trademark Journal and is given an opposition period of two (2) months from the date of publication;

8.When the opposition period elapses and no objection is received, the Registrar will issue you with a certificate of registration;

Apply Online

1.You are required to start by contact a local accredited trademark agent to assist in the online filing and registration process. This is so because it is only accredited agents that can use the Trademarks Registrys online registration process;

2.The accredited agent visits the registrys website http://www.iponigeria.com/ , he / she login his / her registered account by entering his / her information in the LOGIN section and thereafter follow the registration steps as directed by the system;

3.After submission of application and after making payment, you / your agent will automatically receive an Electronic acknowledgement notice on the same day;

Instructions[edit]

1.An applicant must ensure that his / her trademark representation is clear and distinct

2.For applications submitted on line, documents must be submitted in jpeg format;

3.Applicants submitting online applications must that documents are submitted at a minimum of 1200 dpi;

4.Ensure that the trademark representation meets the required dimensions;

5.Applicants must know that Nigeria follows the International Classification of Goods;

6.Different applications must be filed for separate classification of goods for which the trade mark is to be registered;

7.Applications can either submitted at the trademark office or online;

8.Online applications can only be submitted accredited agent;

9.It is advisable to always instruct an attorney or agent to assist in the trademark registration process;

10.Ensure that the contacted attorney / agent is authorized to do so in the country;

11.A chosen attorney / agent must be issued with an authorization document to enable him / her act on your behalf;

12.An attorney or agent can be replaced at any time by issuing a new authorization to another attorney / agent;

13.Applications for renewal of trademark registration must be submitted at least three (3) months from the expiry date;

14.Trademarks are either registered in black and white or in colour;

15.Registration of trademarks in Nigeria is not compulsory;

16.A trademark in Nigeria can be used even when it is not registered;

17.A trader can use his / her trademark after the trademark search as it awaits final registration;

Need for the Document[edit]

A trademark is any letter, word, label, device, colour, number, signature or any combination of the any of these that is used to identify and distinguish goods of one trader from those of others. Trademarks in Nigeria are registered at the Trademarks, Patents and Design Registry in Abuja, Nigeria

1.It is important to note that unless an authorized attorney / agent is replaced, he / she is from the time of appointment responsible for processing registrations of the marks, he has the obligation to provide an address for local service of documents, he should maintain renewals and must defend any oppositions that may occur in the due course;

2.Applicant must ensure that a chosen trademark meets the required standard. This is

  • A chosen trademark must be visible;
  • It must be distinguish products / services;
  • Choose a trademark that is not deceitful;
  • Choose a unique trademark not similar to any other of another trader;
  • A chosen trademark must be able to be used worldwide;
  • Choose a trademark that can easily be produced and reproduce
  • Should be easy to pronounce and easy to remember (if its a word);
  • A trademark should not be misleading and must not causing any confusion;

  • Registration of trademark is full ownership and protection of trademark in the country;
  • With a trademark, goods are easily identified in the market
  • With a registered trademark, a person can file case in Court in cases where a trademark has been encroached;
