Nigeria - Change of Vehicle Ownership

Procedure[edit]

  1. Both the owner and buyer need to visit a vehicle Inspection office nearest to you to initiate change of ownership registration as per the demands of Nigerian law. A series of test might be carried out on the vehicle like emission test to ascertain the vehicle is in good working condition to be driven on Nigerian roads. An inspection report will be issued after inspection which details the specifics of the vehicle and the corresponding emission test done to check the vehicle is in a good condition before it is permitted to be transferred into the names of the new owner.
  2. The former owner of the vehicle needs to give a notice of change to the vehicle registration authority ownership of in Form MVA 5.
  3. Both parties need to fill out the Transfer Forms in the Rates & Taxes offices.
    To effect the change in ownership of a vehicle, the new owner of the vehicle must present the following documents to the licensing officer at the office of initial registration.

    1. Allocation of plate number form (Original)
    2. Proof of ownership (Original)
    3. Means of identification of the buyer
    4. One passport photographs of buyer
    5. A written letter between both parties stating the details of the car or transfer of ownership (letter of transfer)
    6. The receipt of purchase
    7. Third party insurance for the new vehicle
    8. Sworn affidavit
    9. Blue form (allocation of number plate)
    10. Valid vehicle license
    11. Police report to support the change/vehicle inspection report

    The forms must be signed by both parties and it must be done at Rates & Taxes office and witnessed by a Rates & Taxes officer. Upon presentation of documents, the application is processed and assessment made for payment.
  4. The new owner shall pay to the vehicle the fee as may be prescribed by the Joint Tax Board. Pay the processing fees are as follows.
    • Motor vehicle 2,500 Nairas
    • Motor cycle 625 Nairas

Eligibility[edit]

  • The vehicle must have been registered for at least a period of six month before change of ownership can be effected.

Validity[edit]

Valid for as long as the vehicle remain in the names of the new owner.

Instructions[edit]

  • If the ownership of a vehicle is changed, the former owner of the vehicle shall give a notice of the change to the Authority as in Form MVA 5. The new owner shall pay to the Authority the fee as may be prescribed by the Joint Tax Board.
  • The former owner of the vehicle is to present the registration book to the Authority who shall record details of the change of ownership and hand-over the registration book to the new owner.
  • The notice of change shall be given by the former owner and the new owner not later than 30 days after the date of the actual change of ownership and where the notice relates to a vehicle which was imported into Nigeria free of import duty; the notice shall be accompanied by a certificate of payment of import duty, or exemption there from issued to the new owner by the Nigeria Customs Service.
  • After this the authority shall effect every change of ownership in its register.

Need for the Document[edit]

  • Change of ownership certificate is a document indicating that vehicles ownership has been transferred from the previous owner to the current owner.
  • Vehicle registration is a requirement by the state in Nigeria. Its purpose is to establish clear ownership and to tax motorist or vehicle owners.
  • The vehicle must comply with regulations and meet road safety requirements and be covered by third party insurance.

The rules and regulations pertaining the change of ownership of motor vehicle can be found in the Federal Road Safety Commission Act (CAP 141 LFN) National Road Traffic Regulations, 2004 of Nigeria’s laws. These laws commenced on the 12th January, 2004

Others[edit]

The owner of the Vehicle has to change ownership of registration with the inspector of Vehicle Offices in Nigeria by law. Failure to do this is an offence and will attract a fine of N5,000.00 for violation.
