Nigeria - Apply for a n Tourism Development Corporation Certificate

Procedure[edit]

Application forms can be obtained from the Office of the Licensing Authority Nigerian Tourism Development Corporation Authority. or downloaded from the website of http://tourism.gov.ng/. Completed forms are to be returned to the address as stated on the application forms.

Every Owner of every hospitality and tourism establishment in Nigeria is therefore mandatorily required to register its business with NTDC within sixty (60) days of its commencement of operations or from the commencement of operations,apply to the Corporation in the prescribed form for the registration, classification or re-classification of Hospitality or Tourism Establishment on payment of such fee as may be prescribed by the Corporation from time to time.

Every certificate of registration issued by NTDC expires on the thirty-first (31st) day of December in the year of the issue of such a certificate; with renewals required on a year to year basis upon the payment of such renewal fees as may be prescribed by NTDC.

The Corporation may upon such application issue to the applicant, a certificate of registration to operate any premises as a Hospitality or Tourism Establishment; or refuse to grant such a certificate; or grant the certificate subject to such terms or conditions as it may deem fit to impose in the circumstances.

No person shall operate a Hospitality or Tourism Establishment unless he has obtained and is in possession of a current certificate of registration from the Corporation specifying the name and the premises of the Hospitality or Tourism Establishment in respect of which the certificate of registration is granted.

Every certificate issued to a Hospitality or Tourism Establishment shall expire on the thirty - first day of December immediately following the date of issue and shall be renewable from year to year on payment of such fee as may be presented by the Corporation:Provided that where an application for renewal of a certificate is made before the expiry period of the certificate it shall still be valid until a new certificate is granted.

The Owner of every registered hospitality or tourism establishment must display a license in a prominent place, at its business premises, its NTDC certificate of registration indicating the name of the establishment, its classification and the grading status of the tourism and or hospitality establishment.

It is one of the conditions for the grant of NTDC license that the Hospitality establishment logos issued by the NTDC Hotel and Accommodation Authority (the Authority) must be displayed in prominent places of the guesthouse at all times. The prominent places mean the main entrance as well as the door of each of the rooms of the guesthouse, and any places inside the guesthouse as specified by the Authority.

The NTDC Authority may take actions against licensees under the Hotel Act and Accommodation Ordinance (i.e. to cancel, suspend or refuse to renew the license concerned) if the above requirement of displaying logos is not complied with.

Required Documents[edit]

  • Duly completed Application Form;
  • Payment of certificate fee;
  • Evidence of Incorporation /Registration of Business Name with the Nigerian Tourism Development Corporation.
  • Evidence of Companys Article /Memorandum of Association;
  • Current 3 years Personal Income Tax Clearance Certificate (LIRS)of at least two (2)Directors;
  • Bank Reference Letter;
  • Corporate profile of the company including Curriculum Vitae of key personnel supported by Professional Licenses (where applicable);
  • Passport Photograph of the Managing Director/Chief Executive Officer;
  • Development Levy of at least two Directors;and
  • Evidence of remittance of Pay As You Earn Tax for key staff(Limited Liability Company)

Eligibility[edit]

All Individuals or companies interested in Hotel and Tourism Business and other related services are eligible provided they have registered with the Nigerian Tourism Development Corporation Authority.

Instructions[edit]

It is an offence under the State Hotel and Tourism Licensing Law for an operator of a Hotel or other Tourism Establishment to carry on any of Hotel or Tourism businesses in Nigeria without a license duly issued by the Hotel Licensing Authority in Nigeria.

All Owners of hospitality and tourism establishment must comply with the Nigerian Tourism Development Corporation as indicated.

  • Applicants submitting their applications to Nigerian Tourism Development Corporation must adhere to the terms of requirements.
  • Any new establishments must apply for a License from the Authority before commencing operation.
  • Holder of a license should apply for a renewal not less than 3 months prior to the expiry of the license.
  • It is the responsibility of the applicant to ensure that his premises do comply with the lease conditions, Deed of Mutual Covenant and other regulations or laws of Nigeria.


No certificate shall be issued by the Corporation unless the applicant satisfies the Corporation that the following conditions are fulfilled

(a)the application is made in the prescribed form and the prescribed fees for registration and registration materials are paid;
(b)the applicant has duly completed and filed all registration documents at the Corporation Registry;
(c)the applicant is of good character and is capable of operating or managing a Hospitality or Tourism Establishment;
(d)the premises in respect of which the application is made is structurally adapted for use as a Hospitality or Tourism Establishment and are in all respects suit-able for such use;
(e)provision has been made for the proper sanitation of the Hospitality or Tourism Establishment;
(f)the Hospitality or Tourism Establishment should be conducted in an efficient manner;
(g)uninterrupted electricity, portable water, proper fire fighting equipment and adequate security should be provided;
(h)proper provision should be made for storage, preparation and serving of food in the Hospitality or Tourism Establishment;
(i)the premises in respect of which the application is made complies with the health requirements for the time being in force in Nigeria and the prescribed minimum standard

It is the duty of a Hotel Proprietor in Nigeria to take reasonable care of the safety of its customers such that each customer is not injured by the negligence or omission of the Hotel Proprietor, its staff and agents.

Every Hotel Proprietor is mandatorily required to have a notice exhibited conspicuously at the entrance or reception area of its Hotel, and also in the sleeping rooms, intimidating customers of the Hotel that the Hotel Proprietor's liability is limited to N200 (Two Hundred Naira) in respect of any one article or N2,000 (Two Thousand Naira) for the aggregate of all the customer's items lost or damaged while a fee paying Guest at the Hotel.

Nigerian Tourism Development Corporation has a duty to register,classify,grade and monitor hotels and other hospitality establishment and it charges fees,imposes such sanctions as may be prescribed from time to time by the Corporation.
