Procedure[edit]

The trademark is published before registration, in the local newspaper. There is no opposition period. The registration procedure lasts 12 months. The application process includes the following procedures and Formalities, i.e., for compliance with the filing requirements.

Classification[edit]

Step 1: you must ensure that the goods or services fall within the class(es) listed in the application for a trade Mark.

Step 2: Descriptiveness of the trademark, you should ensure that the trademark functions solely to provide information about the goods and services affiliated with the trademark;

Step 3: Distinctiveness trademark,you should ensure that trademarks are capable of being represented graphically and of distinguishing goods or services of one individual or organization from those of other individuals or organizations;

Step 4: Deceptiveness of the trademark you should ensure that the trademark of such a nature as to deceive the public (for instance as to the nature, quality or geographic origins of the goods or services);

Step 5: you should ensure that the trademark does not Conflict with prior an earlier registration, prior filed application or earlier unregistered rights resulting from an official search.

  • It takes approximately 12 months in Liberia to file and receive a trademark certificate of registration.

After registration the trademark is published in the Official Gazetteby the applicant to ensure that no one can claim the same trademark.

  • There is no opposition period from the date of publication of acceptance.

Required Documents[edit]

  • Power of attorney legalized up to the Liberian Consulate. In the absence of a Liberian Consulate the documents may be Apostilled to the Hague Convention.
  • An Oath (declaration of ownership) legalized as above.
  • Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
  • The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.
  • Details of the trademark owner (name, address, registration number).
  • Invoicing details (name, address, fiscal number, registration number).
  • In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Eligibility[edit]

Any person who sets up a business or other activities has an obligation to register with the Liberia Registration Service Bureau. It is mandatory for an individuals or companies to register their trademark in Liberia.



Fees[edit]

Step-1 Trademark Comprehensive Study such fees is
  • 1 Class Euro 295
  • Each additional class $80
Step-2 Trademark Registration Request
  • 1 Class $560
  • Each additional class $850
  • Step -3 Trademark Watch is $95



Validity[edit]

The protection lasts 15 years from the filing date.

Instructions[edit]

The law provides that all business or other activities has to be registered in Liberia and those having trademark to protect them through registration.



Required Information[edit]

  • Full name of the applicant
  • Passport size photograph with a white background
  • Address and signature of applicant
  • Citizenship
  • Trade name proposed to be used
  • The class of goods or services
  • If the applicant is a foreign company , a power of attorney or form of authorization to an advocate of the High Court of Liberia will be sufficient.

Need for the Document[edit]

A trademark in this country may be registered through one of the 2 available systems of trademark registration:

1. National trademarks may be registered through the State Trademark Office.

2. International trademarks may be registered through W.I.P.O. system.



Information which might help[edit]

  • The trademark renewal may be done within 1 month before expiry.
  • For the trademark renewal you will need the power of attorney legalized up to the Liberian Consulate.
  • In the absence of a Liberian Consulate the documents may be Apostilled to the Hague Convention.
  • It is also needed a copy of the Certificate of Registration and/or last renewal certificate. *After trademark renewal the protection lasts 15 years
  • For changing the name or the address you will need the power of attorney duly legalized up to the Liberian Consulate and the certificate of change of name/address.
  • For the trademark assignment you will need the power of attorney notarized and legalized up to the Liberian Consulate and an trademark assignment deed.
  • For licenses you will need powers of attorney from licensor and licensee legalized as above and a license agreement signed by both parties.



Other uses of the Document/Certificate[edit]
