Liberia - Register a Civil society

Procedure[edit]

Civil Society Organizations (CSOs) in Liberia to the fully recognized must register as an unincorporated or incorporated organization; then seek approval from the Ministry of Planning and Economic Affairs and finally register with the National Civil Society Council of Liberia.


1.Registering civil society as an unincorporated organization: In this case, the organization is registered in accordance with the associations Law of Liberia;


2.Incorporating civil society organization: This is registering an organization in order to be legally recognized by government; incorporating organizations is done by registering them at the Ministry of Foreign Affairs and is done as follows:

  • The applicant should start by visiting the ministry to find out what is required to successfully register a society in Liberia;
  • After finding out what is required, prepare all documents required;
  • Prepare an application for incorporation and submit it together with the required documents to the ministry;
  • At the Ministry of Foreign Affairs, the submitted documents are reviewed, assessed and decision is made on whether to register society or not ;
  • If application is approved, an article of incorporation is issued to the organization;


3.Obtaining accreditation / approval from the Ministry of Planning and Economic Affairs: This is done as below:

  • Here, the applicant still starts by visiting the ministry to find out what is required for a society in Liberia to be accredited;
  • Thereafter knowing what is required, prepare all necessary documents;
  • Go to the offices of the Ministry of Planning and Economic Affairs and obtain an application form for accreditation and fill it accurately;
  • Then submit filled application form together with a letter of request for accreditation and required documents to Civil Society Organization Registry at the Ministry of Planning and Economic Affairs;
  • At the Ministry of Planning and Economic Affairs the submitted applications are assessed and decision is made on whether to approval civil society or not. The applicants must be aware that submitted applications may either be rejected or accepted.
  • When submitted documents for a society is not approved, reasons for denial are given and in most cases are given verbally and the applicants are advised to take correct measures;
  • When documents are approved, the Ministry of Planning and Economic Affairs (MPEA) issues a Certificate of Accreditation to the applicant / society.


4.Registration at the National Civil Society Council of Liberia:

  • The applicant start by visiting the National Civil Society Councils premises / offices to find out what is required to obtain membership in the councils;
  • Prepare all required documents;
  • Pay registration fees as defined by the councils policy regulation;
  • Obtain a membership form, fill it careful and submit it together with required documents to the council;
  • When documents are submitted, they are viewed and assessed and decision is made to either give membership or not;

Eligibility[edit]

To be eligible to be registered, an organization must have been set up for purposes of benefiting its members or for purposes of benefiting the public targeting either a specific group of people or the general population;



Fees[edit]

  • Articles of incorporation for local NGOS from the Ministry of Foreign Affairs US $50
  • Articles of Incorporation for international NGOs US$500



Validity[edit]

1.Accreditation from the Ministry of Planning and Economic Affairs (MPEA) three (3) years

2.Membership at the National Civil Society Council of Liberia must be renewed annually

Processing Time[edit]

Instructions[edit]

1.An applicant must know the type of civil society he / she would like to register;

2.Applicants must ensure that the organization to be registered meets the required number of initial members;

3.The organization to be registered must be set up in line with the not-for profit corporation act;

4.If the organization has been operating as unincorporated association, while registering, it must use the same name as the unincorporated association;

5.Ensure that the organizations has all documents required to successfully register;

6.Usually reasons for denial of approval are communicated verbally;

7.If an applicant is not contented with decision by the planning ministry, he / she can file an appeal with the Standing Independent Appeal Board;

8.Endeavor to create a bank account in the name of the civil society;

9.The created bank account must be with at least two signatories;

10.Group must have not less than three (3) full time staff members;

11.Re-approval applications should be submitted within three (3) months prior to expiry date of initial approval;

12.An organization must have an office with staff and a Board of Directors

13.The society must have a physical address and have a bank account

14.Applicants must be aware that the government does not have funds set aside for Civil Society Organizations (CSOs).

15.Foreign societies must have legal status in home country of origin and should be able to prove activities in other countries;

16.Applicants must endeavor to meet obligations after registering;

Need for the Document[edit]

Civil societies are Non Profit Organizations (NGOs) / institutions that show interests and will of citizens. They are either individuals or organizations which are independent of the government in a given society. The civil society organizations include Community Based Organizations (CBOs), Faith Based Organizations (FBOs), Non Profit Organizations (NPOs), Trade Unions, Indigenous Peoples Movements (IPMs), Foundations among others. In Liberia, the Associations Law is mandated with the incorporation of all Civil Society Organizations (CSOs) through the Ministry of Foreign Affairs, which makes the organizations legal entities and the Non Government Organization (NGO) Policy administered by the Ministry of Planning and Economic Affairs is used to control activities of Non Government Organizations (NGOs).

Therefore civil societies should register with the Ministry of Foreign Affairs and the Ministry of Planning and Economic Affairs and thereafter register with the National Civil Society Council of Liberia which coordinates Civil Society Organizations in the country.

  • A foreign applicant who wishes to register a foreign civil society organization should know that incorporation of such an organization, it must have an authorization to operate in the country.
  • This is done by preparing and submitting application for Authority to Operate in Liberia.
