ProcedureEdit

Those who have the degree can enroll as Advocates (the uniform term for lawyers in India) at the State Bar Council (SBC) of the State where they plan to primarily practice. This is done after paying fee prescribed by the SBC and fulfilling all formalities prescribed, including giving copies of degree, filling up a form, getting recommendations from other advocates etc.

The SBC will then issue an Enrollment Certificate. However, the Enrollment Certificate will not allow you to argue in court or take up cases as an Advocate as you will need to pass the All India Bar Exam conducted by the BCI from time to time to get the "Certificate of Practice". Once you have this certificate, you are free to practice in a court of law or such similar judicial or quasi judicial body.

After the notification of S.30 of the Advocates Act, 1961, on 15 June 2011, advocates can now practice as a matter of right in any court in India irrespective of their state bar registration without the need to transfer their membership to that state bar.
