  1. If the birth happened in a hospital, registration is usually performed automatically. The documents required for issuing the first birth certificate must be presented to the registrar's office. Ask hospital officials on how they can help you with the registration.
  2. If the birth occurred at home, it will be the doctor or the midwife who will complete the registration of birth form, which will then been be submitted to the registrar. This is possible in the event that the registry office is in the same area where the child was born.
  3. After registration, the registry office will issue a birth certificate and registration form. And if the child has Austrian citizenship and whose principal residence is in Austria authorities will also issued a Certificate of Citizenship.

  • Birth certificates of the child's parents
  • Marriage certificate of the parents of the child

    • For foreign nationals: Passport or national identity card
  • Confirmation coming from the mother of the child
  • May divorce decree or decision with confirmation of the legal validity of the divorced (this is available from the divorce court) or marriage certificate of the last marriage and death certificate of spouse
  • Possibly partnership deed
  • Maybe proof of academic degrees the child's mother
  • Declaration on the Vornamensgebung (if you have already decided on a first name)
  • Maybe proof of paternity
  • "Notice of birth" when the birth was not of the head / head of a hospital
  • If needed, notice of change of name
  • Special power of attorney from the hospital demand to empower the illegitimate father or another person to have to perform the authentication.


Note:

  • All foreign language documents must be submitted in original along with a certified translation in Austria.
  • Whether certified translations from other states are recognized based on the applicable rules of procedure. In recognition of the documents, for example, an Apostille may be required. Additional information can be found on the website of the Federal Ministry for European and International Affairs, or call the appropriate Registrar.
  • A foreign language document must be submitted in original along with a certified translation, the translation must be done usually only by court-certified interpreters / translators. A list of Austria in court-certified interpreters / interpreter can be found on the website of the Federal Ministry of Justice.   • The physician / doctor and the midwife who attended the birth
  • The father or mother of the child, if they are able
  • The authority or agency of the police, the investigation carried out on the birth

Registration must be done within a week after the child was born, hospital staff can aid you in filing in the form. If you haven't decided yet on what name to call your child, you can register the birth at the latest, within a month.

For election or declaration of the first name or the name for a newborn at birth out of wedlock, the parents are entitled to the mother of illegitimate birth in the rule. It is important to explain in writing, which first name or first name which was given to the child / were. Names that are not commonly used as a given name or are detrimental to the welfare of the child may not be registered. Well at least the first first name must match the gender of the child. If it should be either exotic name, call the registrar's office.

Whether a child is born legitimate or illegitimate, depends on the time of birth. If, for example, was married on the day of birth before the birth, the child is born in wedlock. If the mother is married, is generally assumed that the husband is the father, and he is entered in the birth certificate.

For a child born out of wedlock or if the origin conditions are unclear ( eg, the husband is not the father), the biological father can, however, only if the following conditions are given on the birth certificate:

  • when he makes a qualified acknowledgment of paternity with the consent of the youth office, where the principal residence is located (this type of paternity Kenntnisses is possible only for children with Austrian citizenship) or
  • it was found by a final court judgment.


Competent Authority

The civil status office where the child should be registered would depend on the place of birth ( eg location of the hospital):

  • The registry office or the registrar's office association of community
  • In statutory cities : the Registry Office of the Municipality
  • In Vienna: the registry office in Vienna

Need for the DocumentEdit

A Birth Certificate states the name and sex of a person, it also indicate the time and place of birth, it is issued after you have registered the birth of a child and may be obtained from the registry office.

You need a birth certificate as evidence of personal data, and often used as documentary requirement.

The right to issue a birth certificate are for:

  • Persons to whom the record relates, and any other persons whose civil status is affected by the entry

  • Persons who can demonstrate a power of attorney for this purpose in the original by the owner / holder of the birth certificate or other documents
