ProcedureEdit

Apply In-Person:

  1. The Applicant should visit the Land use and Administration Committee (LAC) in the Ministry of Lands or any of its field offices in other districts to make the application.
  2. The locations for “Land use and Administration Committee (LAC)” can be found in the "Office Locations & Contacts" of this page.
  3. At the “Land use and Administration Committee (LAC)” the applicant will be issued with an application form to fill and submit.
  4. After filling the form submit the forms to the Land Use Administration committee (LAC) of the county and collect an acknowledgment invoice for payment.
  5. Complete the payment and preserve the payment receipt for reference.
  6. The applicant should then place an advertisement in the Kenya Observer to give room for objections (if any) to the grant of Certificate of Occupancy.
    • If no objection is received within 21 days statutory waiting period, the application will be processed by the relevant departments of the Ministry of Lands.
  7. The LAC will liaise with relevant apartments to facilitate with the acquisition of the occupation certificate.
  8. The process will take a maximum of 21 days. The occupation certificate will be forwarded for stamping and subsequently registered same for the owner’s collection.
  9. The applicant can then collect their Certificate of Occupancy duly signed and registered.
    • The letter of Certificate of Occupancy is issued to the applicant with a plot and block Number.

  • The purpose of obtaining a certificate of occupancy is to prove that, according to the law, the house or building is in liveable condition. Generally, such a certificate is necessary to be able to occupy the structure for everyday use, as well as to be able to sign a contract to sell the space and close on a mortgage for the space.
