Apply In Person

  1. To Probate a Will, the applicant has to approach the Supreme Court link
  2. The first step is to file a petition for probate at the Supreme Court of Jamaica. The petition must include the original will, a death certificate, and a list of all beneficiaries and their addresses.
  3. All the necessary documents are mentioned in the “Required Documents” section of this page.
  4. A notice of the intended probate must be published in a newspaper circulated in the parish where the deceased person resided. This is done to give notice to any interested parties who may wish to contest the will.
  5. Once the notice has been published, the court will schedule a hearing to determine the validity of the will. The executor or administrator must attend the hearing, along with any beneficiaries or interested parties.
  6. If the court is satisfied that the will is valid and there are no objections, it will issue a grant of probate.
  7. This document gives the executor or administrator the legal authority to administer the estate according to the terms of the will.
  8. The executor or administrator must then collect the assets of the estate, pay any debts and taxes owed, and distribute the remaining assets to the beneficiaries as specified in the will.
  9. This entire process can be completed within 15 - 30 days or as per the timeline advised by the respective department authority.
