Temporary Non-resident CDLEdit
For individuals who have lawfully entered the U.S. but have not received a Social Security Number (SSN) yet. (Once the SSN is received, the individual must then apply for a non-resident CDL.)
- Present the following documents at the driver license office:
A valid passport issued to the applicant by the country of which the applicant is a resident,
A valid temporary worker visa, an Employment Authorization Document, or Form I-766; and
A valid Form I-94/I-797 Arrival/Departure record or a successor document. - Pay the required $21 fee.
Non-resident CDLEdit
For individuals with a valid Social Security Number.
- Present the following documents at the driver license office:
A valid Social Security Number,
A valid passport issued to the applicant by the country of which the applicant is a resident,
A valid temporary worker visa, an Employment Authorization Document, or Form I-766; and
A valid Form I-94/I-797 Arrival/Departure record or a successor document. - Pay the required $121 fee.

EligibilityEdit
DPS may issue a Temporary Non-resident CDL or a Non-resident CDL.
- A Temporary, 60-day non-renewable, non-resident CDL may be issued to an individual who does not have a Social Security Number.
- A Non-resident CDL is issued to an individual who presents a valid Social Security Number.
To apply you must:
- Meet all CDL requirements.
- Be a resident of a country whose licensing standards do not meet the testing and licensing standards established by 49 CFR 383
Note: A non-resident is not eligible for a hazardous material endorsement.
Residents of Mexico and Canada
Individuals who hold a valid CDL from Mexico or Canada have reciprocity with the U.S. and may use that license to operate a commercial motor vehicle in Texas. Since Mexico and Canada residences have reciprocity, they do not qualify for a non-resident or non-domicile CDL.

ValidityEdit
A temporary non-resident CDL may not be renewed and will expire on the date that comes first among the following options:
- 60th day after the CDL is issued,
- Expiration date of the visa presented, or
- Expiration date of the Form I-94, Arrival/Departure record or successor document.
A non-resident CDL will expire on the date that comes first among the following options:
- The expiration date of the visa, or
- The expiration date of the Form I-94 Arrival/Departure record or a successor document.
