Procedure

Apply In-Person

1. To apply for Mining Surface Rights, the applicant should visit the Botswana Land Board or Sub Land Board offices within the area of the jurisdiction; where the mining activities will take place. Use this link to view the address details for Botswana Land Board or Sub Land Board offices Link
2. Applicants are required to collect the Application form for Common Land Right. Copies of the Application Form are available for free at any of the Botswana Land Board or Sub Land Board offices countrywide or directly download it using this link; Link (Application form).
3. The application form duly completed in all respect, and the supporting documentation should be submitted to the Botswana Land Board or Sub Land Board offices within the area of the applicants’ jurisdiction.
4. The receiving official will then verify that all the necessary documentation and information have been provided and that the applications comply with the selection criteria before registering the application file.
5. Applicants will be issued with an acknowledgment letter as proof of submission of the application.
6. The application file will then be forwarded to the land board Committee for assessment of the application for availability of the land and consideration, which is within 3 months.
7. Applicant should visit the Botswana Land Board or Sub Land Board offices where the application was filed after the processing period lapse to check the outcome.
8. If successful; the mining surface rights will be printed on a paper with special security features and issued to the applicant against their identity document and the acknowledgment letter.
9. Upon obtain the Mining surface rights, the applicant applies and obtains a prospecting license from the department of mines. Armed with these licenses, the applicant identifies suitable areas for the mining. The surface rights run simultaneously with a mining permit from the Department of mines.

• Certified copy of valid National Identification Card (Omang)
• Letter of representation (For Societies/Churches/Business) or Power of attorney in case of companies
• Copy of Certificate of Incorporation, Company Registration and Shares Certificate for registered Companies
• Copy of Certificate of Registration from Registrar of Societies for Societies
• Letter of consultation from neighboring land users/community
• Locality sketch plan
• Copy of award of tender (in case of contractors, the grant is tied to the duration of the contract).
• Copy of Instrument signed under Married Persons Property Act (proof of Marriage regime if married and Affidavit if not married)
• Decree absolute and court order where applicable
• Copy of Death Certificate, in case of widow/widower

• BWP10.00 application fee
• BW P150.00 for sketch plan fee
• BWP100.00 for lease preparation fee
  

Note: Lease charges are stipulated under common law lease rentals.
