ProcedureEdit

Apply In-Person:

  1. To Obtain Lay-off Certificate or Termination of Service, the Employer has to visit any nearest office of the National Insurance Board (NIB) in his/her state of residence. The address and contact details of branch offices across the country can be found in the following link address details
  2. Visit the office and get an application form for Lay-off Certificate (Form B80) from the relevant officer.
  3. Or the employer may also download the form from the official website of the NIB Link to Download Form B80
  4. Fill the application form with appropriate information under relevant sections.
  5. In order for the NIB to determine the correct rate of benefit, you need to provide the total insurable wages on which contributions have been paid or are due to be paid in respect of the time spent in your employ by the terminated employee within the last 12 months in the “Period of Employment” section.
  6. Give the terminated employee, the fully completed Termination of Services/Lay-off Certificate, on the day that his/her services are terminated.
  7. And finally, send a copy of the certificate to the Director of National Insurance within a week of the date of the employee’s termination.

If an employer doesn’t comply with this requirement, they’re guilty of an offence and liable to face penalties.


Information which might helpEdit

According to Regulation 47 (5) of the NIS Benefit Regulations, an employer who contravenes or fails to comply with the requirements of this regulation (provision of the termination certificate) is guilty of an offence and is liable on summary conviction to a fine of $1,000 or, where the offence consists of continuing the contravention or the failure after conviction thereof, $1,000 together with a further $200 for each day on which the offence is continued.
