This procedure explains various ways to Register Patent in Zamboanga City.
Apply in Person
- Here's how you can apply for a Philippine patent in person. But, before you start your application, you will need to do a quick search using IPOPHL's database first and read documents about granted patents, patent applications, and pending patents. Try to look for patents that bears similarity with the one you are applying for. If you can, do a little bit of research. This first step can save you a lot time and effort in future, so, be sure to do this first. Here's the link - IPOPHL Patent Search
- Next, you will need to fill out three (3) copies of the Patent Application Form (link to download the form can be found under the 'Documents to Use' section).
- Attach the following document to your application forms:
- Specification and description of the patent:
- The Title
- A brief statement of its nature and purposes
- Brief explanation of the drawings, if any
- Complete and detailed enabling description
- Distinct and explicit claim or claims which the applicant seeks to be protected
- Abstract of the invention
- Drawings of the invention
- Specification and description of the patent:
- Submit the required documents and pay the application fee at the IPOPHL cashier.
- Your application will be examined by IPOPHL and will be published for opposition.
- The Office will also conduct substantive examination.
- Once your application is approved a patent certificate will be issued to you. The granted patent will also be published to inform the public.

EligibilityEdit
For an invention to be deemed patentable, the Intellectual Property Code of the Philippines set three conditions that must be fulfilled:
- It has to be new: An invention is not considered new if it already forms part of the domain of prior art. Prior art is explained in the Intellectual Property Code of the Philippines, Chapter 2, Section 24 - 24.2
- Involves an inventive step: Having regard to prior art, it is not obvious to a person skilled in the art at the time of the filing date or priority date of the application claiming the invention.
- Industrially applicable: This applies to any invention that can be produced and used in any industry.
Who can file the application: The patent application can be filed by any individual or juridical entity. For applicants who are non-residents of the Philippines, they must appoint a Resident Agent or Patent Attorney.

For small entities (with 100M worth of assets or less):
- Filing fee (up to 5 claims): PHP 2,000
- Claims in excess of five (5): PHP 180
- Publication: PHP 920
- Substantive Examination: PHP 2,010
- Letters Patent Certificate: PHP 600
- 2nd Publication: PHP 920
For big entities (more than 100M worth of assets):
- Filing fee (up to 5 claims): PHP 4,320
- Claims in excess of five (5): PHP 360
- Publication: PHP 960
- Substantive Examination: PHP 4,200
- Letters Patent Certificate: PHP 1,200
- 2nd Publication: PHP 960
Note: Total fees to be paid may vary depending on the number of claims, classes and embodiments applied. All fees are subject to 1% Legal Research Fund (LRF) as required by R.A. 3870. If the fee is below P 1,000.00, the LRF is P 10.00.
ValidityEdit
- A patent shall be in effect for twenty (20) years from the filing date of the application. On the 5th year, maintenance fees or annual fees must be paid by the holder. If the annual fee is not paid, the patent application shall be deemed withdrawn or the patent shall be considered as lapsed from the day following the expiration of the period within which the annual fee was due.
- The annual fee shall be paid upon the expiration of four (4) years from the date the application was published. Payment of the annual fee may be made 3 months before the due date.
- A grace period of six (6) months shall be granted for the payment of the annual fee, upon payment of the prescribed surcharge for delayed payment.

- A grant issued by the government, an invention patent bestows an exclusive right to an inventor over a product or process that provides any technical solution to a problem in any field of human activity which is new, inventive, and industrially applicable.
- The inventor gains an exclusive right to exclude others from making, using, or selling the product of his invention during the life of the patent. Patent owners also have the option of granting permission to, or license, other parties to use their inventions on mutually agreed terms. Owners may also sell their invention rights to someone else, who then becomes the new owner of the patent.
