ProcedureEdit

  1. To renew an industrial design resignation, you will need to complete and submit an application for renewal to the Swedish Patent and Registration Office. Renewals can be done online or in person by visiting a PRV Office.
  2. You will need to complete the renewal application form. The form is available online (see link provided under 'Documents to Use' section). The registration is valid for one or more five-year periods, counted from the date that you filed your application. You can indicate in your application how many periods you would like your registration to be valid for. Alternatively, you can renew your design protection at the end of each five-year period.
  3. PRV will check if your application is formally correct and that all the necessary documents have been included.
  4. Pay the renewal fee.

FeesEdit

Fees according to the Design Protection Regulation (1970:486): Fee (SEK)

  • Filing fee for registration of a design. One five-year period. (According to section 29, most recent wording 2001:295): 1 900
  • For each additional five-year period (applies in conjunction with registration, see above): 2 500


Additional fees: Fee (SEK)

  • Class fee for each additional class a design or several designs from a multiple registration are classified in: 500
  • Multiple registration fee for each additional design: 1 400
  • Storage fee for each specimen: 800
  • Publication fee for each additional image: 200
  • Reinstatement fee: 500


Note: Fees for government services, such as applications and registrations, and copies and printouts of public documents, are exempt from VAT.

Design Registration Renewal

An application for renewal must not be made earlier than one year before and at the latest, six months after the expiration of the current registration period.

Need for the DocumentEdit

Having a design registered grants you an exclusive right and prevents others from using it. No one else can manufacture, sell, import or hire a product that infringes your design protection.

In the event that someone would use your protected design, despite you drawing their attention to the fact that you have design protection, you could be able to take pursue legal action. The Patent and Market Court can then ban the infringer from continuing to use it, and you can receive damages. Sometimes the court can even impose a fine or prison sentence.
