- To Change Communal Property to Private Property, the applicant has to approach the Registro Agrario Nacional. link
- The decision to change communal property to private property must be made collectively by the community members. This decision usually requires a formal community assembly or meeting where the majority of community members agree to the change.
- The community's decision to change the status of the land must be submitted to the National Agrarian Registry (Registro Agrario Nacional, RAN) and other relevant agrarian authorities for approval.
- In some cases, a consultation process may be required with the community members to ensure that the decision is made with their full knowledge and consent.
- Once the change is approved, the RAN will issue a certification or resolution documenting the change from communal property to private property.
- The communal land will then be divided into individual parcels, and individual land titles (escrituras) will be issued to each landholder or private entity.
- The new individual land titles must be notarized by a Notary Public (Notario Público) and registered with the Public Registry of Property (Registro Público de la Propiedad) to ensure their legal validity.
- An application form will be provided to the applicant by the concerned officer.
- The applicant has to fill in all the necessary details in the application form. (Incomplete applications are not accepted)
- Make sure that the applicant has attached all the necessary documents that are mentioned in the “Required Documents” section of this page.
- The applicant has to attach the photocopies of the required documents along with the application form while submitting.
- Submit all the documents with the completed form to the concerned officer.
- The applicant has to pay the prescribed fee as requested by the authority.
- After receiving the application, the concerned authority will check the submitted application and document set. If all are in place, the application will be accepted.
- Inform the Tax Administration Service (Servicio de Administración Tributaria, SAT) about the change in land status to update tax records.
- This entire process can be completed within 15 days or per the timeline the respective department authority advised.
